Payment Terms
Terms are subject to approval of Mortech Manufacturing’s credit department. On first orders terms are COD or pre-pay with credit card. After your first order, you can complete a credit application to open a NET 30 day account. If payment is not received within 30 days, 1-1/2% late charge per month (18% annual rate) will be added to buyer’s account. Mortech Manufacturing maintains a minimum order amount for retail orders $25.00 and wholesale orders $50.00. Foreign shipments require payment in advance by wire transfer or letter of credit.
Freight
All priced items are FOB Point of Origin. Freight will be added to the invoice.
Fork lift many be required at time of delivery.
Installation NOT included
Shipments
Purchaser may select a carrier for shipments of orders and arrange pickup of merchandise from our facility. In the event your order does not indicate or request a carrier, Mortech Manufacturing is not responsible for delays in shipping and will not be held liable for damages caused by delays in shipments.
Except for obligations stated under warranty, our responsibility for products ceases upon delivery to the carrier. The unloading of shipment is the responsibility of the buyer. In the event of loss or damage during shipment, your claim should be made against the carrier. If notified, Mortech Manufacturing will render all possible assistance in securing the claim.
Freight forwarders: Customer who prefer to use their own freight forwarder are welcome to use the company of their choice. Any order that not shipped through Mortech’s forwarders are FOB Azusa, CA. Mortech will not be responsible for any damage claims. This will have to be filed through customer’s forwarder.
Small Packages: All small package shipments are insured for up to $100.00 through FedEx. Adding insurance for the total cost of the order strongly suggested and is an option for the customer at time of order at the rate published on FedEx.
Damaged Merchandise
INSPECT YOUR SHIPMENTS IMMEDIATELY. Notify the delivering carrier of any damage. All damages, whether apparent at time of delivery or concealed must be reported to the delivering carrier within 48 hours. Do not accept a damaged or short shipment without noting on bill of lading.
DAMAGE CLAIMS: Customer has been advised that it is their responsibility when receiving freight to inspect package thoroughly PRIOR to driver leaving. Note any damage on the bill of lading BEFORE signing. If the box/crate looks to be damaged, inspect the interior for possible damage to the equipment. Once the bill of lading is signed and damage is not noted, customer will not be covered for replacement of the damaged equipment.
Steps to take at time of delivery:
1. Verify Count – Make sure you receive as many skids as are listed. If shortage is discovered, note how many skids are short on carriers receipt and have driver note the shortage on your copy.
2. Carefully examine each skid for damage prior to driver leaving. If damage is visible, note this on the delivery. Open immediately and conduct a joint inspection with the driver. Any damage should be noted on the delivery receipt, please retain your copy of the receipt with all notes.
3. Immediately after delivery, open all cartons and inspect for concealed damage. Even though the driver has left, all cartons should immediately be opened and contents inspected for possible concealed damage. All damage does not need to be itemized on the delivery receipt. Once damage is noted on the delivery receipt, a damage claim can easily be processed.
Mortech will not accept a damage claim 5 business days after delivery. It is the customers responsibility to open each skid to inspect within a timely manner.
Changes / Cancellations
Changes may be subject to additional charges to be determined at the time of the initiated changes. Cancellation requests from the purchaser require the written consent of Mortech Manufacturing Materialaccepted for credit is subject to a minimum service charge of 30% plus freight. Custom ordered products may not be returned for credit. The purchaser shall be liable for reasonable costs and expenses incurred by Mortech Manufacturing prior to notice of cancellation. This amount shall not be less than 30% of the value of goods ordered.
Custom or ‘Rush’ orders: will require full payment in advance. Should the customer decide to cancel their order prior to fabrication, there will be a percentage deducted from their payment. If fabrication has already begun, no refund will be issued. This policy also includes deposits received on prepaid projects.
Delays Resulting in Storage: If there is any delay in a project, customer must provide Mortech written notice prior to completion of fabrication. If the project has been completed through fabrication, under Mortech’s sole discretion may apply storage fees.
COVID-19 Update
In order to protect our employees and our customers from any additional risk, we have made the decision to change our merchandise return policy.
We will not be accepting returns of any merchandise until further notice*.
Once a product has left our facility, we cannot accept it back and give a refund.
*Possible stipulations apply if your item has not been unpackaged in anyway, please call to discuss.
OLD RETURN POLICY THAT IS CURRENTLY NOT VALID UNTIL FURTHER NOTICE: Merchandise that has been ordered from Mortech and has proven defective may be returned to Mortech within 30 days for replacement or adjustment, subject to the following conditions:
Products acceptable for full credit
1. Products not supplied in accordance with the customer’s orders.
2. Products which are defective at the time of receipt by the customer.
3. Returns other than the above are subject to a restocking fee up to 50%.
Products not acceptable for full credit
1. Products which have been discontinued.
2. Products which are personalized or customized.
3. Non-Mortech products which are supplied to a customer as an accommodation.
4. Products not purchased through Mortech.
5. Any product which has been used or without the original packaging.
Prices
ALL PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE. All prices are individually priced, unless otherwise noted. At the time of publication, all catalog list prices are current. Any typographical errors on prices can void an order at Mortech’s discretion.
Taxes
Any taxes or any other governmental charge upon production, sales and/or shipment of goods sold hereunder, now imposed by federal, state or municipal authorities, or hereinafter become effective, shall be added to the price herein and shall be paid by the buyer.
Invoicing
Mortech Manufacturing will invoice upon completion of fabrication. Materials stored 30 days after invoicing will be assessed a minimum of 2-1/2% per month storage fee per order. Additionally, no shipment will be made for any past due accounts. In the event that the buyer has a dispute with the invoice or the invoice amount, buyer must notify Mortech Manufacturing within seven (7) days of receipt of the invoice. Failure to notify Mortech Manufacturing of any dispute within (7) days constitutes agreement with the final invoice.
Acceptance
Receipt of our price list does not constitute an offer to sell. All orders are subject to acceptance by Mortech Manufacturing.
Cost of Collection
The buyer agrees to pay all reasonable attorney’s fees and other costs of collection. Purchaser agrees that any claim, dispute or controversy arising out of a relating to this transaction shall be made or brought solely and exclusively in the state of federal court having jurisdiction of Azusa, California, which is in Los Angeles County, California. Purchaser hereby consents to personal jurisdiction in said forum.
Warranty
Mortech Manufacturing Company, warrants all fabrications to be free of defects due to its own workmanship and materials for a period of up to 1 year. This duration will vary by product type purchased. Mortech Manufacturing Company, must be notified of any warranty issues prior to customer making/requesting repairs from any outside sources.
CONTINENTAL UNITED STATES
Repair and/or replacement of parts furnished that may develop such defects, will be warranted for a period of one year parts replacement and 90 days labor from the date of shipment. Items not manufactured by Mortech Manufacturing will receive the manufacturer’s warranty.
INTERNATIONAL
(For validation of warranty, installation location (physical address) required) Replacement of parts furnished that may develop such defects, will be warranted for a period of (18) months from the date of shipment. Shipping and Labor is not warranted. Items not manufactured by Mortech Manufacturing will receive the manufacturer’s warranty.

CONTINENTAL UNITED STATES
Unless prior special warranty or guarantee required for individual projects, Mortech Manufacturing standard warranty will apply.
Mortech Manufacturing warrants to the original purchaser and installed at the original location that the walk-in polyurethane wall and ceiling panels manufactured by the company are free of defects in materials or workmanship, under conditions of proper installation by a licensed refrigeration contractor and normal use and service, for a period of (7) years from the date of shipment. Removal, installation, and freight of defective panels are not covered under this warranty.
Insulated floors and doors are warranted to be free from defects under normal use and service for (1) year from date of shipment. Inspection may be accepted by photograph or approved by a Mortech Manufacturing authorized inspector. Mortech Manufacturing warranty determination is final. The obligation of Mortech Manufacturing under this warranty shall be limited to repairing or replacing, at the company’s discretion, the panels that prove to be defective, FOB factory. Removal, installation, and freight of defective panels are not covered under this warranty.
All hardware and accessories manufactured by other companies carry their own warranties. Mortech Manufacturing makes no claim for application or fitness for a particular use. In no event shall Mortech Manufacturing be liable for loss of use, revenue or profit or for any other indirect, incidental, special, or consequential damage including, but not limited to, spoilage or product loss.
This warranty is in lieu of all other warranties expressed or implied and does not apply to equipment which has been subject to any accident, alteration, abuse, misuse, or improper installation.
Mortech Manufacturing warrants that products, except Service Parts, manufactured by Manufacturer shall be of a merchantable quality, free of defects in material or workmanship, under normal use and service for a period of one (1) year from date of original installation, or eighteen months from date of shipment by Mortech Manufacturing, whichever first occurs. Service parts, for product out of original warranty, should be so warranted for a period of twelve (12) months from date of installation, or eighteen (18) months from date of shipment whichever may first occur. Removal, installation, and freight of defective panels are not covered under this warranty.
This warranty to include shipping and handling, labor charges for a period of (30) days from the date of shipment.
International
Unless prior special warranty or guarantee required for individual projects, Mortech Manufacturing standard warranty will apply. International warranty does not include shipping and handling, labor charges for repair or replacement of defective parts. All hardware and accessories manufactured by other companies carry their own warranties.
